Welcome to PhotoSoul. These Terms & Conditions govern your use of photosoulstudio.com and your purchase of products and services from PhotoSoul.

By accessing our website, placing an order, uploading photographs, or purchasing a product from PhotoSoul, you agree to these Terms & Conditions.

If you do not agree with these terms, please do not use our website or place an order.

1. About PhotoSoul

PhotoSoul is an online personalised gift and printing store offering products including, but not limited to:

  • Photo frames
  • Polaroid prints
  • Photo prints
  • Customised gifts
  • Personalised products
  • Wall décor
  • 3D-printed products
  • Other customised and printed products

Product availability, specifications and prices may change from time to time.

2. Placing an Order

Customers may place orders through our website, WhatsApp, or other official PhotoSoul ordering channels.

When placing an order, you are responsible for providing accurate information, including:

  • Your name
  • Contact number
  • Delivery address
  • Product selection
  • Required size, colour and finish
  • Personalisation details
  • Photographs or other files required for the order

PhotoSoul is not responsible for delays, failed deliveries or incorrect products resulting from incorrect information supplied by the customer.

3. Order Confirmation

Submitting an order does not necessarily mean that the order has been accepted.

An order may be confirmed by PhotoSoul through the website, telephone, WhatsApp or another official communication channel.

We reserve the right to decline or cancel an order where:

  • The requested product is unavailable
  • The information supplied is insufficient or incorrect
  • The uploaded content cannot reasonably be processed
  • There is a suspected fraudulent transaction
  • A technical or pricing error has occurred
  • We are unable to fulfil the order for another legitimate reason

If an order is cancelled after payment has been received, any applicable refund will be handled according to our Refund Policy.

4. Customised Products

Many PhotoSoul products are individually produced according to customer requirements.

Because customised products are made specifically for the customer, cancellation, return or exchange may not be possible once production has started, except where required by applicable law or where the product is defective or incorrectly produced by PhotoSoul.

Customers should carefully check:

  • Spelling
  • Names
  • Dates
  • Photos
  • Product sizes
  • Colours
  • Personalisation details
  • Other information supplied for production

PhotoSoul is not responsible for mistakes resulting from incorrect information supplied by the customer.

5. Customer-Uploaded Photographs

Customers may be required to provide photographs for personalised products.

By uploading or sending a photograph, you confirm that you have the necessary rights or permission to provide that photograph to PhotoSoul for the purpose of fulfilling your order.

You must not knowingly submit content that:

  • Infringes another person’s copyright or other rights
  • Is unlawful
  • Contains malicious software
  • Is intended to abuse or harm another person
  • PhotoSoul reasonably believes cannot be legally or safely processed

PhotoSoul reserves the right to refuse an order involving content that may create legal, safety or operational concerns.

6. Product Images and Colours

We make reasonable efforts to display product images and colours accurately on our website.

However, actual colours may vary depending on:

  • Your monitor or mobile-device display
  • Screen brightness and settings
  • Photography and lighting
  • Printing materials
  • Printer characteristics
  • Different paper, frame or product finishes

Minor differences in colour, positioning, cropping or appearance may therefore occur.

Such minor variations do not necessarily constitute a product defect.

7. Photo Quality

The quality of a finished printed photograph depends partly on the quality of the original image supplied by the customer.

Low-resolution, heavily compressed, blurry or otherwise poor-quality images may produce lower-quality printed results.

Where reasonably possible, PhotoSoul may inform the customer if an uploaded image appears unsuitable for the selected product.

If the customer chooses to proceed despite a quality warning, PhotoSoul cannot guarantee a high-quality result from a low-quality source image.

8. Cropping and Image Adjustment

Certain products may require photographs to be cropped, resized or adjusted to fit the selected product dimensions.

PhotoSoul may make reasonable adjustments necessary for production.

Where a particular crop or layout is important, customers should communicate their requirements before production begins.

9. Prices

All prices displayed on the website are subject to change without prior notice.

The price applicable to an order is generally the price displayed or communicated at the time the order is confirmed, subject to correction of obvious pricing or technical errors.

Promotional prices may be available only for a specified period or while stocks last.

10. Payment Methods

PhotoSoul may offer one or more of the following payment methods:

  • Cash on Delivery (COD)
  • Bank transfer
  • Card payments
  • Other payment methods made available by PhotoSoul

Payment availability may vary depending on the product, location and order.

Where a third-party payment provider is used, payments may also be subject to that provider’s terms and conditions.

11. Cash on Delivery

Where Cash on Delivery is available, the customer agrees to pay the full amount due when the order is delivered.

COD may not be available for every product, location or order.

PhotoSoul may require advance payment for certain customised products or orders where appropriate.

Repeated refusal to accept confirmed COD orders may result in restrictions on future COD orders.

12. Delivery

PhotoSoul may deliver orders through third-party courier or delivery services.

Estimated delivery times are provided as estimates and are not guaranteed delivery dates.

Delivery may be affected by:

  • Courier delays
  • Weather conditions
  • Public holidays
  • Address problems
  • Incorrect customer information
  • Customer unavailability
  • Other circumstances outside PhotoSoul’s reasonable control

Customers are responsible for providing a valid delivery address and reachable telephone number.

13. Delivery Charges

Delivery charges, if applicable, will be displayed or communicated during the ordering process.

Promotional offers may include free or discounted delivery for specified products, locations or periods.

PhotoSoul reserves the right to change delivery charges and promotional delivery conditions.

14. Failed Deliveries

If a courier is unable to deliver an order because of:

  • Incorrect address
  • Incorrect telephone number
  • Customer being unavailable
  • Customer refusing the package
  • Failure to respond to delivery attempts
  • Other circumstances attributable to the customer

additional delivery charges may apply for re-delivery.

For customised orders, refusing delivery does not automatically cancel the customer’s payment obligation where the product has already been specially produced.

15. Inspection Upon Delivery

Customers should inspect their order as soon as reasonably possible after receiving it.

If the product is visibly damaged during delivery, please contact PhotoSoul as soon as possible and provide:

  • Order details
  • Photographs of the package
  • Photographs of the damaged product
  • A description of the issue

This information may be required to investigate the matter with the delivery provider.

16. Returns and Exchanges

Due to the personalised nature of many PhotoSoul products, returns or exchanges may not be available simply because a customer changes their mind after production has started.

However, PhotoSoul will consider issues involving:

  • Manufacturing defects
  • Incorrect products
  • Significant production errors
  • Products damaged before or during delivery

Any approved return, replacement or refund will be handled according to our Refund & Return Policy and applicable law.

17. Incorrect or Defective Products

If PhotoSoul produces an item incorrectly due to an error on our part, we may, depending on the circumstances:

  • Replace the product
  • Reproduce the product
  • Repair the product where appropriate
  • Provide another appropriate resolution

Customers should notify PhotoSoul within a reasonable period after receiving the product.

Evidence such as photographs or videos may be requested to verify the issue.

18. Cancellation of Orders

Customers may request cancellation before production begins.

Once production or printing has started, cancellation may not be possible for customised products.

If an order has already been produced or dispatched, cancellation may not be accepted except where required by applicable law or agreed by PhotoSoul.

19. Intellectual Property

All content appearing on photosoulstudio.com, including:

  • PhotoSoul branding
  • Logos
  • Product photographs
  • Graphics
  • Website design
  • Text
  • Promotional materials
  • Original designs

is owned by PhotoSoul or used with appropriate permission and may not be copied, reproduced, modified or commercially exploited without permission.

Customers retain ownership of photographs and other content they provide to PhotoSoul, subject to the rights necessary for PhotoSoul to fulfil the customer’s order.

20. Customer Responsibility for Uploaded Content

The customer is responsible for ensuring that photographs, artwork, logos, designs and other content submitted to PhotoSoul can legally be used for the requested purpose.

PhotoSoul is not responsible for disputes arising from a customer’s unauthorised use of copyrighted, trademarked, personal or otherwise protected material.

21. Website Accuracy

We make reasonable efforts to keep product descriptions, photographs, prices and other information on our website accurate.

However, occasional errors may occur.

PhotoSoul reserves the right to correct errors, update information and make changes to products, prices and availability without prior notice.

22. Website Availability

We aim to keep photosoulstudio.com available and functioning properly.

However, we do not guarantee that the website will always be:

  • Available without interruption
  • Completely error-free
  • Free from technical problems
  • Free from security vulnerabilities

Temporary interruptions may occur because of maintenance, hosting problems, internet issues, technical failures or circumstances beyond our reasonable control.

  • Customer misuse of a product

Nothing in these Terms & Conditions is intended to exclude or limit any liability or consumer right that cannot lawfully be excluded or limited under applicable law.

25. Events Beyond Our Control

PhotoSoul will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • Floods
  • Severe weather
  • Fire
  • Power failures
  • Internet or telecommunications failures
  • Courier disruptions
  • Government restrictions
  • Strikes
  • Civil disturbances
  • Epidemics or pandemics

27. Prohibited Use
